Data Protection Agreement and Terms of Use for “Refline” E-Recruiting

1. Protection of Personal Data
Zurich University of the Arts (ZHdK) attaches great importance to the protection of your personal applicant data when you use the “Refline” application form provided by our software partner Refline AG (with headquarters in Baar and a branch in Zurich). In doing so, we comply with cantonal data protection law (Information and Data Protection Act, IDG) and, where applicable, with the Swiss Federal Data Protection Act (DSG) and the European General Data Protection Regulation (GDPR).

2. Data Processing Policy

Any personal application data and supporting documents submitted via “Refline” are processed and stored by ZHdK for the evaluation, allocation and internal forwarding of your application as well as for the filling of vacant positions.

In the application process, in particular opening salutations, surname, first name, date of birth, nationality and the usual correspondence details such as postal address, e-mail address and telephone numbers are processed and stored in our applicant database. In addition, all documents submitted in connection with applications will be recorded.

If you would like us to consider your application documents for other vacancies at ZHdK requiring similar qualifications, please provide your consent by clicking “Accept opt-in (Yes or No)” as applicable. Your agreement will be kept on file. If your qualifications are considered suitable, they will be marked accordingly.

Your personal data may be processed anonymously for statistical purposes (e.g. reporting). However, no conclusions about individuals may be drawn from such data processing.

3. Storage and Dissemination of Personal Data
Applicant data will be stored and processed in Switzerland, on the systems provided by our software partner Refline AG.

Data transfer is SSL encrypted. Data processing is carried out in compliance with general data security standards and by means of state of the art technology. Zurich University of the Arts has secure web access at its disposal.

4. Data Access
Applicant data will be accessible to our HRM staff and to the senior staff responsible for recruitment. Where a selection committee is appointed, external experts will also have access to applicant data.

In exceptional cases, employees of our software partner Refline AG, which is called in for support purposes, will also have access to your data.

Under no circumstances will your data be passed on to other companies or persons or used for other purposes. Your data will be processed in Switzerland.

5. Data Security and Confidentiality

Zurich University of the Arts and Refline AG have taken the necessary organisational and technical security measures to ensure the confidentiality, integrity and availability of applicant data as well as to protect and continuously improve any personal data stored on their systems against manipulation, loss and unauthorised access by third parties. However, the transfer of information via the Internet and other electronic means is always subject to certain security risks. Zurich University of the Arts is therefore unable to guarantee the security of information transmitted in this way. All ZHdK and Refline AG staff are obliged to maintain strict confidentiality about applicant data within the scope of their employment and are bound by official secrecy. Any external members of selection committees are also bound by official secrecy based on a signed confidentiality agreement.

6. Consent and Basis of Data Processing
By clicking “I accept the data protection agreement,” you agree to the storage and processing of your data. Your consent makes your personal data available to ZHdK for the purpose of filling vacant positions within the organisation. Your consent to data processing will be kept on record.

7. Data Deletion
The application documents of unsuccessful applicants will be automatically deleted six months after the respective vacancy has been filled.

If you have provided your consent that we may consider your application documents for other vacancies (see Section 2, Paragraph 3), you will automatically be asked after 11 months, or after 10 months if a deadline extension has already been granted, whether your application documents should remain in our database for a further period or be deleted.

8. Right to Information
Applicants may request information about which data are processed. If you wish to receive such information, please send us a copy of your official ID (passport or identity card). Please address your request to ZHdK HRM.

You may change or delete your electronic data at any time. You may revoke your consent to the processing of your data. In this case we will delete your application immediately. Please submit your request to:

9. Terms and Conditions of Use
Personal data must be true, correct and up-to-date at the time of submission. Data should not be incomplete, misleading or deceptive. Applicants are reminded that submitting false information may lead to the termination of a possible employment relationship.

10. Liability
Applicants are reminded that electronic applications are made at their own risk and responsibility. The liability of Zurich University of the Arts is excluded to the extent permitted under applicable law.

11. Final Provisions
Technology development and the implementation of new technologies and laws may lead to this Privacy Policy and Terms of Use being modified with immediate effect and without notice.

This Data Protection Agreement is governed by Swiss law. The place of jurisdiction is Zurich, Switzerland.
